User & Online Auction Agreement

1. Role of İstanbul Antiques Auction

İstanbul Antiques Auction operates as an auction platform and intermediary facilitating the sale of artworks, antiques, collectibles and other property offered by sellers.

Unless expressly stated otherwise, İstanbul Antiques Auction is not the owner or seller of the property offered at auction.

İstanbul Antiques Auction is entitled to charge commissions for its auction and intermediary services.

2. Condition and Inspection of Lots

All artworks, antiques, collectibles and other items offered at auction are sold in their existing condition and on an “as is” basis.

Photographs, descriptions, dimensions, dates, artist names, signatures, periods, origins, provenance, condition information and other catalogue information are prepared on the basis of the information and assessments reasonably available at the time.

Unless expressly stated otherwise, such information does not constitute an absolute guarantee or warranty.

Bidders are responsible for reviewing the description, photographs and other available information concerning a lot before bidding. Additional information, photographs or condition reports may be requested from İstanbul Antiques Auction prior to the auction where available.

3. Participation and Bidding

Users may be required to maintain a valid registered account in order to participate in an online auction.

Account credentials are personal and must not be shared with third parties. Users are responsible for activity conducted through their accounts.

Every bid submitted during an auction constitutes a binding offer and cannot normally be withdrawn or cancelled once submitted.

Bidding continues until the time specified for the relevant lot. The highest valid bid recorded by the auction system at the conclusion of bidding will be considered the winning bid.

İstanbul Antiques Auction reserves the right to determine and modify bidding increments.

The electronic records maintained by İstanbul Antiques Auction will be used to determine the operation of the auction and bids recorded by the system.

4. Buyer's Premium and Additional Charges

The successful bidder will be charged a buyer's premium ranging from 10% to 35% in addition to the winning bid.

The exact buyer's premium applicable to each auction or lot will be stated in advance.

Applicable taxes, duties, customs charges, import/export costs or other mandatory charges may be payable in addition to the purchase price and buyer's premium.

Bidders are responsible for reviewing the applicable buyer's premium and any other disclosed charges before bidding.

5. Payment

The successful bidder must pay the total amount due within 7 days following the conclusion of the auction.

Following the auction, İstanbul Antiques Auction will contact the successful bidder by email, telephone or another registered communication method and provide the total amount due and payment instructions.

Payments must only be made in accordance with the payment instructions provided by İstanbul Antiques Auction.

İstanbul Antiques Auction's obligation to release or dispatch the purchased property arises only after the purchase price, buyer's premium and all applicable additional charges have been paid in full.

6. Failure to Pay

If the successful bidder fails to make payment within the required period, İstanbul Antiques Auction reserves the right, subject to applicable mandatory rules, to cancel the transaction, suspend or terminate the user's account, restrict the user from participating in future auctions and seek compensation for losses incurred.

A successful bidder who subsequently decides not to proceed with the purchase is not automatically released from payment obligations or the applicable buyer's premium.

7. Delivery and Shipping

Following receipt of full payment, purchased property will be delivered or shipped according to arrangements made with the buyer.

Unless otherwise stated, shipping, packing, insurance, customs, import, export and similar costs are the responsibility of the buyer.

For international shipments, buyers are responsible for determining and complying with import, customs and other requirements applicable in their country.

İstanbul Antiques Auction cannot be held responsible for delays caused by carriers, customs authorities or other circumstances outside its reasonable control.

8. Catalogue Descriptions and Attributions

References to artists, makers, periods, dates, origins, techniques, signatures, provenance, literature and similar information may be based upon available research, information and expert opinion.

Expressions such as “attributed to”, “manner of”, “school of”, “circle of”, “after”, “workshop of” and similar terminology should not be interpreted as an unconditional guarantee of authorship.

If an error or relevant new information is identified in a catalogue description or image, İstanbul Antiques Auction reserves the right to correct or update the information before or during the auction.

9. Withdrawal and Modification of Lots

İstanbul Antiques Auction reserves the right to withdraw any lot before or during an auction, postpone its sale, combine or divide lots where appropriate.

Where a serious question or claim concerning ownership, origin, authenticity or another material issue arises before or during an auction, İstanbul Antiques Auction may suspend or cancel the sale of the relevant lot.

10. User Accounts

Persons under the age of 18 may not participate in auctions.

İstanbul Antiques Auction may request verification of identity or contact information where reasonably necessary.

Accounts containing false, incomplete or misleading information may be suspended or terminated.

İstanbul Antiques Auction may restrict or refuse participation where reasonably necessary for security, suspected fraud, unpaid obligations or protection of the integrity of the auction.

11. Technical Issues

İstanbul Antiques Auction cannot, to the extent permitted by applicable law, be held responsible where a bid cannot be submitted or is delayed because of internet connections, devices, browsers, servers, software, power failures or other technical circumstances outside its reasonable control.

In the event of a significant technical problem, İstanbul Antiques Auction reserves the right to suspend, extend, restart or cancel the affected lot or auction.

12. Returns, Cancellation and Withdrawal

Bids submitted in an online auction are binding.

A successful bidder's change of mind, decision that the item is no longer wanted or claim that a bid was placed accidentally does not automatically entitle the bidder to cancellation of the transaction.

Nothing in these terms excludes any mandatory rights available to a buyer that cannot legally be waived or excluded by agreement.

13. Liability

Where İstanbul Antiques Auction acts as an intermediary for a seller, it shall not, to the extent permitted by applicable law, be responsible for inaccurate or incomplete information supplied by the seller.

Nothing in these terms shall exclude or limit any liability of İstanbul Antiques Auction that cannot lawfully be excluded or limited.

14. Catalogue Content and Intellectual Property

Photographs, texts, descriptions, designs and other content published in the online catalogue, website or auction system may not be commercially copied, reproduced or published without the permission of the relevant rights holder.

15. Changes to Taxes and Other Obligations

Where applicable taxes, customs duties, import/export requirements or other mandatory financial obligations change after publication of an auction, the applicable changes may be reflected in the transaction.

16. Acceptance of this Agreement

Every user who creates an account, registers for an auction or places a bid acknowledges that they have read, understood and accepted this User & Online Auction Agreement.

Placing a bid constitutes acceptance of these terms.

İstanbul Antiques Auction reserves the right to update these terms when necessary. The terms applicable to an auction will be those published at the time the user participates in the relevant auction.
